What was supposed to be a momentous day for the Jenkins family of Chicago ended in tragedy. Problems during the delivery of their infant son limited the oxygen available to the fetus, resulting in later diagnoses of mental retardation and cerebral palsy. The baby was eventually delivered via Cesarean section, but the malpractice suit that was later filed contended that the crucial damage occurred when the doctors continued to pursue vaginal birth aided by vacuum extractors, even after indicators suggested that the infant was experiencing distress.

Former Supreme Court Nominee Settles Slip-and-Fall Suit
When law professor and controversial former Supreme Court nominee Robert Bork ascended a dais at the Yale Club during a speaking engagement in June 2007, he might have expected his ideas to come under assault, but not his physical safety. Instead, due to what Bork has claimed was an unstable speaking platform, his attempt to reach the podium ended in a serious fall. Bork suffered numerous injuries from the incident, including a burst hematoma in his leg. The original suit asked for $1 million in damages, but the exact amount transferred in the settlement has not been released.

Florida Woman Files Suit Against Makers of “Eco-Friendly” Power Generator
Nancy Younger and her husband William were trying to help the environment by installing a device known as the IdleAire into their big-rig truck, but they ended up losing much more. William Younger died as a result of the incident, and Nancy sustained a near-fatal case of carbon monoxide poisoning. An award of up to $18 million is expected in the case.

New Jersey Man Receives $809,000 Following ER Misdiagnosis
When a 14-year-old male gymnast visited the emergency room complaining of nausea, abdominal pain, and groin pain, personnel at Heywood Hospital issued a diagnosis of appendicitis. When further tests disproved that diagnosis, a testicular infection was believed to be the cause of the illness. In truth, however, the boy was suffering from testicular torsion, a rare condition that is somewhat more common among young male athletes. However, because the condition was not diagnosed soon enough, the patient eventually had to have one of his testicles surgically removed. After a five-year court battle, the plaintiff was granted a combined award of more than $800,000 in compensation and interest.

State of Ohio Settles Wrongful Death Suit for $1 Million
A tragic car crash in 2006 cost one Ohio mother her life. Lori Smith, 32, died in the fiery aftermath of a collision caused by an Ohio state trooper. The officer who caused the collision was traveling at a high rate of speed, reportedly en route to an area hospital to check up on the seriously ill infant of a coworker. According to court documents, the officers who caused the collision were not engaged in a legitimate chase that required traveling at such a high rate of speed. Smith’s survivors, including her husband and three young children, filed a wrongful death case in the incident. Although the exact details of the state’s settlement have not yet been released, officials have confirmed that the award will exceed $1 million.

Texas Teacher’s Family Files Lawsuit in Big Rig Crash
33-year-old Texas schoolteacher Cynthia Carter was proceeding through an intersection one autumn afternoon in 2006 when the driver of a big rig ran a red light and struck her vehicle. After the collision, Carter’s truck was dragged 150 yards before it burst into flames. Carter was killed instantly, leaving behind a husband and three young children. Her family has filed a lawsuit in the incident, claiming that the driver has a troubled driving history. The suit also names the big rig’s operating company, which has faced several past citations for operating its trucks in an unsafe and careless manner. The driver, Jeremy Davidson, is also facing criminal charges in the incident.

Lawsuit Filed in Border Patrol Agent’s Death
36-year-old David Webb was monitoring the desert near Why, Arizona in his work-issued Chevy Tahoe truck on November 3, 2006 when a tragic series of events caused the Border Patrol agent’s untimely death. First, the tread separated from one of the truck’s rear tires, causing Webb to loose control of the vehicle. When the truck flipped over, the roof of the vehicle caved completely in, causing the fatal head and brain injuries that doctors say caused Webb’s demise. Last week, Webb’s surviving family members, including a wife and two young children, filed suit against both General Motors and Continental Tires, claiming that defects and safety problems with both the vehicle and the tires directly contributed to Webb’s death.
