On December 23, 2007, Indiana resident Jose B. Lemus-Rodriguez was shot and killed under unclear circumstances. That night, Lemus-Rodriguez had been detained for suspected intoxication while driving. Soon afterward, Lemus-Rodriguez escaped, leading Fort Wayne police on an extended car chase. After police had managed to slow Lemus-Rodriguez’ vehicle, James Arnold, a newly recruited police officer, fired his weapon repeatedly at the car, emptying an entire ammunition clip into the driver’s side. Lemus-Rodriguez sustained nine bullet wounds in the incident, which ultimately proved fatal. A wrongful death claim has recently been filed on behalf of the Rodriguez family.

Texas Woman Claims that Chemotherapy Treatment Caused Stroke
When Ivalyn Anderson of Orange, Texas arrived at the Ben Rogers Cancer Institute to begin chemotherapy treatment for her disease in 2006, she and her family were holding out hope for a speedy recovery. Unfortunately, Anderson suffered a stroke soon after she began treatment, an outcome that she blames on the method that was used to administer her chemotherapy drugs. A subcutaneous central venous access device was inserted into one of Anderson’s veins to dispense medication, and soon afterwards, Anderson suffered a stroke, a traumatic rupture of her subclavian artery, and permanent injuries to her brain and heart. Anderson’s medical malpractice suit claims that the misplacement of the device – and the staff’s subsequent failure to recognize the error – caused her injuries.

$11.4 Million Jury Award in Wisconsin Birth Injury Case
A recent case in Crawford County, Wisconsin underscored the potential severity of medical missteps that occur during the labor and delivery process. The family of a young boy who sustained severe brain injuries at birth filed malpractice claims against several medical staff members at the Gunderson Lutheran Medical Center in La Crosse, Wisconsin. Specifically, the case claimed that a nurse and nurse midwife at the center acted negligently in the course of overseeing the patient’s delivery. A jury agreed with the substance of these claims, awarding the family $11.4 million in the case. Much of the award will be administered in a trust to help cover the patient’s health cover costs.

New Lawsuits Add to Utility Terrain Vehicle Safety Concerns
Although utility terrain vehicles have long been a target of safety concerns, two recent injuries sustained by drivers and passengers of the model known as the Yamaha Rhino have added even more fuel to the fire. Critics claim that the Yamaha Rhino’s design is fundamentally flawed, with a top-heavy center of gravity that increases the risk of the vehicle flipping and rolling over. That’s exactly what happened in the cases that precipitated the two most recent lawsuits against Yamaha. In two separate incidents, an 11-year-old Tennessee girl and a 47-year-old Georgia man sustained serious injuries in rollover accidents.

Families File Suit in Fatal Big Rig Wreck
On October 3, a van that was shuttling employees and job candidates between correctional facilities for interviews was struck by a big rig truck in Montgomery, Alabama. The van had previously undergone modifications to make it sufficiently secure to transport prisoners, and as such, the backseat passengers were unable to get out of the van after the crash. Seven passengers died as the vehicle was engulfed in flames. The trucking company, the truck driver, and the warden of the county correctional system have all been named as defendants in wrongful death suits filed by surviving family members.

Washington State Birth Injury Case Yields $4.25 Million Award
When an infant’s oxygen supply is cut off during the labor and delivery process, brain injuries and cerebral palsy are often the sad results. Tragically, these cases are often precipitated by preventable medical mistakes. That’s exactly what a Kirkland, Washington jury said happened in the case of 5-year-old Miriam Tavaras. Although her mother’s pregnancy had been classified as high risk, the jury found that hospital staff did not take proper precautions in the case or respond appropriately when signs of fetal distress were detected. The award of $4.25 million is intended partially to help fund the lifelong medical care that Miriam will require.

Alabama Police Officer Killed in On-the-Job Collision with Big Rig
29-year-old Pell City, Alabama police officer, Kenneth Surles, was making his nightly rounds in his patrol car when he was struck by a diesel truck. The big rig was driven by James Scogin, who investigators claim failed to yield at an intersection before colliding with Surles’ patrol car. Scogin has been indicted on several criminal charges in the case, and the Surles family’s lawsuit against both Scogin and his employer, Hugghins Transportation, is moving forward.
